Adler, Cohen, Harvey, Wakeman and Guekguezian LLP handles many types of employment matters. For example, we have a great deal of experience in handling all types of discrimination cases, including claims of discrimination based on age, race, sex, disability and national origin, filed before the Massachusetts Commission Against Discrimination (MCAD) and the Equal Employment Opportunity Commission (EEOC). Our work in this area also includes the growing area of sexual harassment, which presents unique facts requiring interpretation of human behavior. Many discrimination claims are removed from the MCAD and/or EEOC and filed in state or federal court, where our background and knowledge of state and federal anti-discrimination statutes and our litigation experience benefits our clients.

In addition to discrimination cases, we frequently handle employment disputes involving claims for breach of contract, defamation, tortious or intentional interference with contractual or advantageous relations, and violation of various state and federal statutes, to name a few. These cases often present a challenging variety of claims and issues, and we are known for providing our clients with thorough analyses, expert representation, and a fair and effective resolution, when possible. As in our other fields of practice, we have extensive experience in alternative dispute resolution processes, such as mediation, and we provide our clients with the necessary information and analysis to enable them to decide whether to engage in negotiations with the opposing party. If resolution is not possible, we take a creative and focused approach to steering the case through the litigation process. We consider whether the cases can be disposed of through pre-trial motions, such as motions for summary judgment, and we always tailor our discovery to each specific case, with the goal of presenting a thorough and organized case at trial.

In conjunction with the firm's practice in the area of professional liability, including representation of medical, dental, chiropractic and other health care providers, we have handled many employment cases in the medical field. These cases often present unique employment issues, such as the rights of health care providers pursuant to various hospital by-laws and medical staff manuals, employee or independent contractor agreements, practice plans and other contractual or quasi-contractual employment arrangements. Our experience also extends to handling cases arising from disputes among professionals practicing in various types of group practices.
